Actus reus

  • Drive a mechanically propelled vehicle on a road or other public place without due care and attention, or without reasonable consideration for other road users.

Mens rea

  • Objective standard: fell below what would be expected of a competent and careful driver — no need to prove subjective foresight of harm.

At the police station

Often arises from collisions. Obtain dashcam, witness accounts, and weather/road conditions. Distinguish from dangerous driving (far below standard / obvious danger).

When to involve a rep or solicitor

Police station advice is free under legal aid and is not means-tested.
