Actus reus

  • Kidnap: take or carry away a person by force or fraud without their consent and without lawful excuse.
  • False imprisonment: unlawfully and intentionally or recklessly restrain a person’s freedom of movement from a particular place.

Mens rea

  • Intention to take/carry away (kidnap) or intention/recklessness as to the restraint (false imprisonment).

Common-law offences — use the CPS Offences Against the Person charging standard alongside the SC guideline. Check duration, use of force/weapons, vulnerability, and whether a sexual or robbery ulterior intent is alleged.

When to involve a rep or solicitor

Police station advice is free under legal aid and is not means-tested.
